TERMS & CONDITIONS

Welcome to Omega Tours. By using our website, requesting information, making a booking, paying a deposit, signing a waiver, or participating in any service, you agree to these Terms & Conditions.

1. General

Omega Tours offers tours, rentals, transportation, riding classes, and selected activities in Baja California Sur, Mexico. Prices are shown in USD unless otherwise stated. Taxes are included unless a product page clearly states otherwise.

2. Reservations and Payment

A booking is confirmed only after the required payment, deposit, or pre-authorization is successfully received and accepted by Omega Tours.

Depending on the product, Omega Tours may require:

  • valid government-issued ID
  • valid driver’s license
  • signed waiver
  • signed rental agreement
  • refundable security deposit or card hold
  • proof of experience when required

Omega Tours may refuse delivery, check-in, or participation if required documents, signatures, authorizations, or payments are missing.

3. Product-Specific Rules Prevail

Certain products have additional rules regarding age, weight, departure time, route limits, experience, deposits, transportation, fuel, or eligibility. If a product page, signed rental agreement, waiver, or check-in form contains specific rules, those specific rules apply in addition to these Terms.

4. Cancellations and No-Show

Unless a specific product page clearly states otherwise:

  • More than 48 hours before service: full refund
  • 24 to 48 hours before service: 50% refund
  • Less than 24 hours before service: non-refundable
  • No-show: non-refundable

Late arrivals may be treated as no-shows when the delay materially affects operations, safety, logistics, or other bookings. Where operationally possible, Omega Tours may, at its discretion, shorten or reschedule the service instead of canceling it.

5. Arrival and Check-In

Guests must arrive on time and complete any required documentation before service begins. Unless a product page states otherwise, Omega Tours recommends arrival at least 15 minutes before the scheduled start time.

6. Safety and Right to Refuse Service

Omega Tours may refuse, suspend, shorten, or terminate a service, with no refund when legally permitted, if a guest:

  • is intoxicated or under the influence
  • is reckless, aggressive, abusive, or unsafe
  • refuses safety instructions
  • provides false information
  • lacks required ability, experience, documents, or authorization
  • attempts prohibited use of the vehicle or service
  • creates a risk for staff, third parties, wildlife, property, or equipment

7. Experience Requirements

Prior riding experience is required for:

  • Dirt Bike Tours
  • Dirt Bike Rentals
  • Scooter Rentals
  • Dual Sport / Motorcycle Rentals
  • any product clearly marked as experience required

Omega Tours may require a riding class instead of the originally requested service if staff reasonably determine that the guest does not meet the experience threshold.

8. Age, License, and Eligibility

Minimum age, passenger eligibility, and driver requirements vary by product. A valid driver’s license is required whenever driving is allowed. Omega Tours may deny service if eligibility requirements are not met.

9. Rentals, Security Deposits, and Charges

Rentals may require a refundable security deposit or card hold. Current operational references include:

  • ATV Rentals: $700 USD
  • UTV Rentals: $1,500 USD
  • Dirt Bike Rentals: $700 USD
  • Scooter Rentals: $300 USD

Additional product-specific deposit amounts may apply if clearly published or confirmed before delivery.

The customer is responsible for damage, misuse, negligence, unauthorized use, prohibited use, fines, towing, rescue, recovery, lost keys, missing equipment, excessive cleaning, fuel shortages, late return, and related costs when attributable to the customer, passengers, or any unauthorized driver.

If a signed agreement, card authorization, or checkout approval allows it, Omega Tours may collect supported post-service charges tied to documented damage, loss, incident, delay, missing equipment, or other contractually authorized amounts.

10. No Insurance Unless Clearly Stated Otherwise

Unless clearly stated otherwise in writing, rentals and off-road vehicle services do not include insurance for the guest. If a product includes insurance, the scope, exclusions, and deductible must be stated specifically in writing.

11. Prohibited Use

The following are strictly prohibited where applicable:

  • driving on the beach
  • driving on federal highways
  • reckless driving
  • racing, jumping, stunts, or abuse of equipment
  • unauthorized drivers
  • operating under the influence
  • operating outside approved areas, routes, or schedules
  • overloading the vehicle beyond permitted capacity
  • using the vehicle in a manner different from the contracted service

A violation may result in immediate suspension or cancellation without refund when legally permitted, loss of deposit protection, extra charges, and liability for resulting damages or costs.

12. Delivery, Pickup, and Transportation Add-Ons

Rental delivery / pickup:

  • Todos Santos Centro: $10 delivery / $10 pickup
  • Todos Santos, Cerritos Beach, and El Pescadero: $20 delivery / $20 pickup

Optional transportation for eligible Omega-operated tours and activities:

  • Todos Santos, Cerritos Beach, and El Pescadero: $10 one way / $20 roundtrip per person
  • Cabo area: $20 one way / $40 roundtrip per person

All delivery, pickup, and transportation services are subject to route, schedule, staffing, and operational availability.

13. Weather, Mechanical Issues, Route Conditions, and Force Majeure

Omega Tours may shorten, delay, reschedule, substitute, or cancel services due to weather, route conditions, safety concerns, wildlife conditions, authority instructions, mechanical issues, access restrictions, force majeure, or other circumstances affecting safe or reasonable operation.

If Omega Tours cancels before the service begins for reasons attributable to Omega Tours or because the service cannot be safely operated, the guest will normally be offered rescheduling or a refund, unless a lawful product-specific rule applies.

Nature-based outcomes, wildlife sightings, ocean conditions, fishing results, and similar variables are not guaranteed.

14. Assumption of Risk

Outdoor, off-road, water, transportation, and adventure activities involve inherent risks, including property damage, serious injury, disability, and death. By participating, guests acknowledge those risks and agree to follow safety instructions, route limits, and operational rules.

15. Liability

Nothing in these Terms waives liability beyond what the law allows. Any limitation of liability applies only to the maximum extent permitted by applicable law. Omega Tours does not accept responsibility for losses or damages caused by the guest’s own acts, prohibited use, intoxication, false information, unauthorized driving, late arrival, failure to follow instructions, or force majeure.

16. Lost Items

Omega Tours is not responsible for lost or forgotten items. If an item is recovered, Omega Tours may offer office pickup or delivery at additional cost, subject to availability.

17. Pets and Service Animals

Where pets are permitted, the guest remains responsible for cage use where required, cleaning, hair removal, odors, stains, interior damage, and extra cleaning charges. Service animals will be handled in accordance with applicable law, but the guest remains responsible for avoidable damage or extraordinary cleaning attributable to the animal.

18. Privacy and Data Use

Use of the website and services is also subject to Omega Tours’ Privacy Policy and, where applicable, its full Aviso de Privacidad.

19. Electronic Acceptance and Records

Omega Tours may use electronic bookings, digital waivers, electronic signatures, card pre-authorizations, message logs, photographs, video, timestamps, IP/device records, and booking system records as part of its operational and evidentiary process.

20. Updates to These Terms

Omega Tours may update these Terms from time to time. The version published at the time of booking will generally govern that transaction, together with any product-specific terms accepted during the booking process.
